Going beyond Enlightenment critiques of ancien régime justice, historians are now exploring its distinctive procedures; courtrooms have become a fundamental site for recapturing early modern political and social dynamics. Historians of science and medicine can benefit too. Serving as expert witnesses was prominent among the activities of medical practitioners; and, especially in Continental Europe, natural and medical knowledge was routinely presented and contested in tribunals. This essay aims to promote further research on the resulting wealth of manuscript and printed sources (...) that give access to crucial social and epistemological issues. The voices of different actors, preserved in trial records, can extend our histories of the body. The relations among medical practitioners, and with the legal authorities, provide a hitherto neglected context within which to understand contemporary epistemological debates, from claims and challenges to expertise to the definition and production of evidence, including the status of signs, personal observation, and tests. Studying early modern medico-legal testimonies can enrich our understanding of witnessing, the focus of much research in the history of science. Expert testimonies were well established in the Roman Canon law, but the sphere of competence of expert witnesses—one of the grounds on which seventeenth-century physicians claimed social and intellectual authority—troubled contemporary jurists. By reconstructing these debates in Counter Reformation Rome, and by placing in them the testimonies given by Paolo Zacchia, one of the founding fathers of legal medicine, this (...) article discusses the epistemological and social issues surrounding the definition of expertise about the body in court. It shows how a high-ranking expert witness would define his competence versus the legal authority on the one hand, and versus lay and lower-status expert witnesses on the other. But it also explores the interactions between specific legal constraints, for example about eye witnessing, and the ways in which different kinds of witnesses would use the body as a source of evidence for testimony. While engaging with medico-legal issues including the ambiguous signs of childbirth and the visibility of pain, the article examines their meanings within Counter Reformation social controversies, including control over sexuality, imposition of discipline and the social status of physicians.Author Keywords: Legal medicine; Seventeenth-century Rome; Expert witnesses; Testimony; Body; Zacchia. In September 2008, 10 years after the untimely death of Pere Alberch (1954–1998), the 20th Altenberg Workshop in Theoretical Biology gathered a group of Pere’s students, col- laborators, and colleagues (Figure 1) to celebrate his contribu- tions to the origins of EvoDevo. Hosted by the Konrad Lorenz Institute for Evolution and Cognition Research (KLI) outside Vienna, the group met for two days of discussion. The meeting was organized in tandem with a congress held in May 2008 at the Cavanilles Institute (...) for Biodiversity and Evolutionary Biology (ICBiBE) in Valencia, Spain. The talks at the KLI were equal parts: nostalgic remembrance, excitement over new ways of thinking about old problems, and an unrepressed vitriol against the resurgence of reductionist thinking in EvoDevo. Here we highlight some of the key aspects of Pere’s life and work that informed and infused the talks. (shrink)

Background Family and Community Health Nurses (FCHNs) are at a higher risk of experiencing emotional exhaustion and feelings of low personal accomplishment. Higher levels of professional identity may decrease these negative feelings. Its measurement could produce positive effects for FCHNs and the quality of care they offer. Aim This study aims to evaluate the psychometric properties (validity and reliability) of the Nurses Professional Values Scale-Revised (NPVS-R) on FCHNs in Italy. Research design A cross-sectional research design was used. Participants and research (...) context A convenience sample of FCHNs was recruited in an out-of-hospital setting from Italy. A total of 202 nurses were eligible (mean age of 41.11 ± 10.55 years; 78.2% female). Ethical considerations The study was performed in accordance with the World Medical Association Declaration of Helsinki. Participants were asked for their consent and were guaranteed anonymity in the information collected. The study was approved by the internal review board of the university. Results Confirmatory Factor Analysis (CFA) supported a unidimensional factorial structure of the NPVS-R with an adequate fit to the data. Internal consistency reliability was also supported. The construct validity was further reinforced by the concurrent validity results showing a positive and significant correlation of professional identity with job satisfaction. Conclusion The NPVS-R is a valid and reliable instrument to measure professional identity among FCHNs. It can be used in clinical practice to improve FCHNs’ psychological-emotional feelings and quality of care provided, in research to allow comprehensive understanding of professional identity, and in educational settings to monitor the professional identity levels of Family and Community Health Nursing students. Résumé Cette contribution se propose d’établir un lien critique entre Ricœur et Fichte afin de déterminer deux objectifs. Le premier objectif consiste à analyser la réception complexe de Fichte par Ricœur, qui constitue à mon avis une approche interprétative intéressante de la philosophie transcendantale. Ricœur souligne la richesse inexplorée de la philosophie fichtéenne, qui se trouve précisément dans la philosophie transcendantale et dans le sentiment d’être en tant qu’affirmation éthique et point de départ de la réflexion elle-même et affirme vouloir (...) rechercher une origine éthique. Le second objectif est souligner la fécondité de l’interprétation de Ricœur, qui oriente la lecture de la morale kantienne et la primauté de la raison pratique. On peut identifier la même direction critique entre les deux philosophes, dans laquelle la vision du sujet est orientée vers une perspective éthique intersubjective et intérieure. (shrink)

Resumen: Esta exposición intenta comprender las formas culturales de comunicación y fijación mnémica en una narración específica que Davi Kopenawa, chamán Yanomami, expone al antropólogo Bruce Albert, en virtud de los modos de existencia amazónicos, refiriéndose en particular a la intensidad de los espíritus selváticos y a la experiencia chamánica con los mundos espirituales. En el contexto de una extensión vegetal dispersa y sobresaliente, afirmamos una sociabilidad cotidiana en el marco de una “ética respetuosa o amorosa” entre todas las formas (...) de vida, expresada estéticamente en formas significantes y transportadoras de emociones desarrolladas por la cosmología amazónica. Para ello utilizamos las nociones que Aby Warburg emplea en su estudio de la cultura de las imágenes, en tanto curso por el que estas pueden entenderse como organismos vivientes susceptibles a transformación, preservando su propia biología en la trasmisión codificada de la memoria.: This exhibition tries to understand the cultural forms of communication and mnemic fixation in a specific narrative that Davi Kopenawa, Yanomami shaman, exposes to the anthropologist Bruce Albert, by virtue of Amazonian modes of existence, especially referring to the intensity of jungle spirits and experience Shamanic with spiritual worlds. In the context of a dispersed and outstanding plant extension, we affirm a daily sociability within the framework of a “respectful or loving ethic” among all life forms, aesthetically expressed in significant and transporting forms of emotions developed by Amazonian cosmology. For this we use the notions that Aby Warburg uses in his study of the culture of images, as a course by which they can be understood as living organisms susceptible to transformation, preserving their own biology in the coded transmission of memory. Este artículo examina la aparición de motivos distópicos en la obra de Ricardo Piglia. Se discuten las afirmaciones sobre narración y poder en “Teoría del complot” y otros ensayos del autor, y las referencias a poder policial y narración en Los diarios de Emilio Renzi y La ciudad ausente. Esto, para señalar que Piglia adelanta una lectura distópica de la historia argentina y latinoamericana. Tal lectura tiene sus bases visuales y narrativas en una tradición novelística y cinematográfica distópica que (...) no ha sido suficientemente reconocida en los trabajos sobre el escritor argentino. Con la reciente publicación de los Diarios y la aparición póstuma de libros de conferencias y entrevistas de Piglia, esa línea de lectura cobra relevancia. (shrink)

Recently, Barbara Renzi argued that Kuhn's account of scientific change is undermined by mismatches in the analogy that Kuhn supposedly draws between scientific change and biological evolution. We argue that Renzi's criticism is inadequate to Kuhn's account of scientific change, as Kuhn does not draw any precise analogy between the mechanisms of scientific change and biological evolution nor aims to argue that the mechanisms of scientific change and biological evolution are similar in any important respects. This book deals with an old conundrum: if God knows what we will choose tomorrow, how can we be free to choose otherwise? If all our choices are already written, is our freedom simply an illusion? This book provides a precise analysis of this dilemma using the tools of modern ontology and the logic of time. With a focus on three intertwined concepts - God's nature, the formal structure of time, and the metaphysics of time, including the relationship between temporal (...) entities and a timeless God - the chapters analyse various solutions to the problem of foreknowledge and freedom, revealing the advantages and drawbacks of each. Building on this analysis, the authors advance constructive solutions, showing under what conditions an entity can be omniscient in the presence of free agents, and whether an eternal entity can know the tensed futures of the world. The metaphysics of time, its topology and the semantics of future tensed sentences are shown to be invaluable topics in dealing with this issue. Combining investigations into the metaphysics of time with the discipline of temporal Logic this monograph brings about important advancements in the philosophical understanding of an ancient and fascinating problem. The answer, if any, is hidden in the folds of time, in the elusive nature of this feature of reality and in the infinite branching of our lives. (shrink)

This book examines the lasting influence of the academic culture wars of the late 20th century on the humanities and progressive politics, and what to make now of those furious debates over postmodernism, multiculturalism, relativism, critical theory, deconstruction, post-structuralism, and so on. In an effort to arrive at a fair judgment on that question, the book reaches for an understanding of postmodern theorists by way of two genres they despised; and hopes, for that reason, to do them justice. The story, (...) in its telling, justifies two basic claims: first, that the phenomenological/hermeneutical tradition is the most suitable source of theory for a humanism that aspires to be truly universal; and, second, that the ethical and political aspect of the human condition is authentically accessible only through narrative. In conclusion, it argues that the postmodern moment was a necessary one, or will have been if we rise to the occasion—and that that is its historical significance. (shrink)

If climate change represents a severe threat to humankind, why then is response to it characterized by inaction at all levels? The authors argue there are two complementary explanations for the lack of motivation. First, our moral judgment system appears to be unable to identify climate change as an important moral problem and there are pervasive doubts about the agency of individuals. This explanation, however, is incomplete: Individual emitters can effectively be held morally responsible for their luxury emissions. Second, doubts (...) about individual agency have become overly emphasized and fail to convincingly exonerate individuals from responsibility. This book extends the second explanation for the motivational gap, namely that the arguments for the lack of individual agency do in fact correspond to mechanisms of moral disengagement. The use of these mechanisms enables consumption elites to maintain their consumptive lifestyles without having to accept moral responsibility for their luxury emissions. (shrink)

Comment penser l’amitié sans recourir à une affirmation politique ou théologique? Nous montrons d’abord la reprise chrétienne et la transformation de l’amitié, telle que la concevait l’Antiquité, à partir de la réinterprétation augustinienne des textes de Cicéron. Puis nous proposons de réfléchir à cette nouvelle conception de l’amitié, en nous appuyant sur les textes de Jacques Derrida, qui cherche à établir la possibilité d’une amitié d’« avant les amitiés », fondée sur aucune fraternité. Pour Derrida, une telle amitié est rendue (...) possible par le langage, qui se pense d’abord comme hospitalité. Nous reprenons enfin la lecture des textes d’Augustin, pour montrer leur convergence avec cette nouvelle définition de l’amitié, en éclairant le rôle qu’y joue la confessio. (shrink)

An examination of the post-Darwinian history of biological taxonomy reveals an implicit assumption that the definitions of taxon names consist of lists of organismal traits. That assumption represents a failure to grant the concept of evolution a central role in taxonomy, and it causes conflicts between traditional methods of defining taxon names and evolutionary concepts of taxa. Phylogenetic definitions of taxon names (de Queiroz and Gauthier 1990) grant the concept of common ancestry a central role in the definitions of taxon (...) names and thus constitute an important step in the development of phylogenetic taxonomy. By treating phylogenetic relationships rather than organismal traits as necessary and sufficient properties, phylogenetic definitions remove conflicts between the definitions of taxon names and evolutionary concepts of taxa. The general method of definition represented by phylogenetic definitions of clade names can be applied to the names of other kinds of composite wholes, including populations and biological species. That the names of individuals (composite wholes) can be defined in terms of necessary and sufficient properties provides the foundation for a synthesis of seemingly incompatible positions held by contemporary individualists and essentialists concerning the nature of taxa and the definitions of taxon names.
